Legal Services

We provide legal support and services to the Council as a whole (and to some external bodies), advising and assisting it in relation to its statutory functions. Areas in which we provide a legal service for the Local Education Authority include:

  • nuisance and disturbances on school premises
  • contract disputes
  • land and property related issues
  • corporate parenting and Safeguarding issues
  • debt recovery issues employment/personnel disputes and issues
  • special educational needs
  • advising and updating the LEA upon changes in legislation and implementation in practice
  • admissions/exclusions
  • non-school attendance and employment of children issues
  • requests for disclosure within court proceedings
  • information Law (in liaison with the Information Governance Team)
  • negligence claims (in liaison with the Insurance Team).

Expertise is available within the team which covers most legal subjects. Non strategic areas in which schools may wish to seek advice from Legal Services include:

  • questions of parental responsibilities and rights
  • problems with contracts, such as photocopier lease and service agreements
  • trespass and trespassers
  • debt collection
  • property issues, such as the letting of school buildings

Buy back package

We recognise that schools' need for legal advice is variable but legal problems are often unforeseen, and in certain cases the costs of legal advice and representation can be very high.

Whilst schools have freedom of choice when it comes to seeking legal advice, our intention is to provide a service to schools from within the allocated subscription package for the first hour only of Legal Services' time spent providing advice upon each particular issue. This will provide schools with the comfort of knowing that a quality legal service is available to them without the fear of hefty and unforeseen legal bills.

Pay as you go

Where more complex legal issues arise, it may be necessary for additional legal costs to be incurred that will fall outside the schools core legal subscription, such as the costs of long running litigation, barristers fees, complex commercial arrangements or adverse costs orders. These situations would, however, be discussed by Legal Services with the school concerned and the LEA before any commitments that affect the school are entered into.
This sets out the terms for the provision of Legal Services to each school on the basis that the first hour of recorded Legal Services time upon each request for legal advice will be provided within the subscription “buy back” package. The “pay as you go” package will be provided at an additional and reasonable hourly rate.
